BCA’s Art Sales & Leasing program provides Vermont artists with opportunities for increased exposure and sales through external exhibitions in public and private locations. BCA handles all aspects of installation and receives a 40% commission on work sold. Clients may purchase or choose to lease artwork for their public spaces using our non-juried, online artist database to explore participating artists. All artwork is insured for the duration of the exhibition by the hosting venue. Participation in this program is non-exclusive, and we encourage artists to explore and foster many options for exhibition, representation, and sales.

This program exists to assist Vermont artists in gaining increased exposure and sales potential, and to increase the viability of the visual arts in the greater Burlington area. Joining BCA’s artist database provides artists the potential to have their work considered for exhibition in our off-site venues as well as for sales, both to private clients and for larger corporate sales projects. Please note that exhibitions and sales are curated and chosen according to client preference, so joining the program does not guarantee that your work will be selected.

Terms & Conditions

  • All artwork submitted for inclusion must consist of original works of art created by the Artist.
  • Once an exhibition venue and date have been agreed upon, the Artist is responsible for delivering work—either directly to the exhibition venue on the date of installation or to 405 Pine St., Burlington, VT 05401—prior to the scheduled install date.
  • Artist must deliver all artwork for lease or purchase in “ready to install” condition: framed or presentable and equipped with all hardware and wiring necessary for hanging safely and securely.
  • Once Artist delivers artwork and artwork is accepted by BCA by way of a signed agreement, BCA will be responsible for all exhibition installation and all artwork available for lease or sale will be insured by BCA and or the exhibition venue against loss or damage for the duration of the loan.
  • Once artwork has been placed in an exhibition lease, the Artist may not remove work from the exhibition prior to the end date of the lease unless agreed upon with BCA, in which case a comparable replacement must be provided.
  • Artwork sold on consignment is based on a 40% commission structure to BCA.
  • In order to have work considered for exhibition or sale, the artist must complete the following submission requirements

 

Submission Requirements

BCA will provide a link (along with instructions) to a shared cloud-based folder. The Artist will use this link to provide and keep updated the following:

  • High-resolution JPEG images of original artwork that is currently available for sale and/or exhibit. Artist will update accordingly as new work is created and/or existing work is sold or becomes unavailable
  • Each image should be titled with: Artist name last/first, artwork title, date of creation, medium, size in inches that notes whether size is framed or image, and price, separated by underscores
  • Example: Ashman_Kate_Blue Sky_2025_oil on canvas_12x12 framed_$1200)
  • Price list for all works submitted. List must include (for each piece): title, year, medium, dimensions in inches, price, framed/unframed (if applicable)
  • Artist statement (bio & résumé may be included as well, but are not required)

  • W9 (for payment of sales and stipends)

 

Conditions of Loan

This agreement is entered into between the City of Burlington, a municipal corporation of the State of Vermont, by and through its department Burlington City Arts (BCA) and the undersigned Lender/Artist. For and in consideration of the promises, covenants, terms, and provisions contained in this agreement, the parties mutually agree.

Preparation: Artist is responsible for delivering all artwork in “ready to install” condition. Artwork must be properly framed or mounted in a way that is both presentable and protected with materials appropriate to the medium. Artwork must be properly equipped with all hardware necessary for hanging safely and securely, including both wiring and the use of eye hooks or D-rings installed on the back. Wiring and hardware must be properly installed, secure, and substantial enough to support the weight of the artwork. BCA will install all exhibiting artwork utilizing hooks and nails or an installed track and cable system provided by the leasing venue.

Packing & Transportation: Artist shall deliver, or assume responsibility for delivering, all consigned items to the exhibition venue on the date of installation or to 405 Pine Street, Burlington, VT 05401, prior to the scheduled install date. If Artist requires any work to be shipped to or from BCA, Artist shall be responsible for all shipping costs. Artist agrees to pack work securely for transport and provide all necessary materials for the safe transport of the work. If necessary, the Artist is responsible for providing detailed packing instructions for all work. Artist agrees to inspect the artwork for damage

upon delivery. Evidence of damage to artwork discovered at the time of receipt or while in BCA possession will be reported immediately. BCA is not responsible for objects damaged prior to arrival or during delivery by the artist to BCA.

Insurance: Artist is required to provide an itemized list of works, including title, size, medium, date of creation and retail price of all work on loan to BCA. BCA will insure the loaned work against loss or damage while in BCA’s possession, including incidents that occur during installation, de-installation,

transportation, or storage. Once artwork has moved to an exhibit, upon completion of installation the leasing venue/client will insure all included artwork against loss or damage while on site for the duration of the exhibit until BCA de-installs the artwork, at which time BCA will resume coverage for the duration of the loan. Damage resulting from improper installation of hanging hardware by artist (ie: malfunction of eyehooks, D-rings, wiring) will not be covered. Artist agrees that in the event of damage, prior to filing an insurance claim, the Artist will work with BCA to ensure timely repair of work through means of artist compensation for labor and materials, conservator compensation, or through other means deemed acceptable by both parties.

Photography and other forms of publication: If requested by BCA, artist will provide print-quality JPEG images for publicity and catalogue reproduction of work that is on loan. Unless permission is refused or limitations are noted below, it is understood that the loaned object(s) may be photographed, reproduced or telecast by BCA for the following purposes: documentation, publicity, publication, and educational programs connected with this exhibition/loan. BCA shall have and will retain the right to reproduce photographs of loaned objects for these purposes in perpetuity. Copyright permission is hereby issued to BCA and BCA is licensed free of charge as it relates to this loan. Artist certifies that they have ownership of all copyrights and licenses and that the artwork is free of restrictions and liens. Under copyright law, Artist retains all reproduction rights to his/her work, unless otherwise specifically assigned.

Commission: Whenever an Artist delivers, or causes to be delivered, a piece of art to BCA for the purpose of sale or exhibition to the public on a commission, fee, or other basis of compensation, the delivery and acceptance thereof by BCA is deemed to be on consignment. Art sold on consignment is

based on a 40% commission structure to BCA. If any adjustment is to be made, an Addendum shall be completed and signed by both parties. Prices for said items shall be set by Artist and approved by BCA. If a sales contact was made through exhibition at BCA, resulting in a sale made directly by Artist through his/her studio or other gallery or sales venue, Artist agrees to pay a 20% commission to BCA. If Artist is represented by another gallery/dealer whose contract requires a split commission on work sold while in its possession, even if the sale is brokered exclusively by BCA, then the sale will reflect the gallery/dealer’s commission rate, or BCA’s, whichever is higher, and will be split 50/50 between the gallery/dealer and BCA.

Art Sales: Artist will provide BCA with retail pricing for all artwork on consignment as well as an up to date W9 reflecting their current mailing address. BCA will act as the agent/seller and work directly with the buyer on all art sales. In the event of a sale BCA will notify the artist and will submit a consignment invoice for artist payment at 60% of the retail value, unless otherwise agreed upon. Artist consignment payments will be processed via the City of Burlington and will be issued by check mailed to the address on file within three weeks of receiving and processing purchaser payment. In the event that a purchaser wishes to acquire purchased artwork prior to the completion of an exhibit, BCA will work with the artist to coordinate securing a suitable replacement if available. Any artist that is paid over $600 within one year will receive a 1099 form. In the event of a change of address, artist should submit an updated W9 to BCA to ensure records are up to date.

Duration of loan: Artwork is to remain in the possession of BCA for the duration of exhibition/loan, until a point of sale or for an amount of time determined in the Loan Agreement. Once artwork has been placed in an exhibition lease, Artist may not remove work from the exhibition prior to the end date of the lease unless a comparable replacement is furnished to BCA or unless otherwise agreed to by BCA. Artwork left at BCA more than a year beyond the established loan period may be considered abandoned, and BCA reserves the right to dispose of such property as it sees fit. BCA will make every attempt to reach Artist via the contact information provided before disposing of said property.

Artist’s Representations and Warranties: The Artist represents and warrants that Artist is the original and only creator of the Artwork, is the sole owner of the Artwork, and that the Artwork is free and clear of any liens and that there are no outstanding disputes in connection with property rights, intellectual property rights, or any other rights in the Artwork or parts of the Artwork and that Artist is the sole owner of any and all copyrights and other intellectual rights pertaining to the Artwork.

Indemnification: Artist shall indemnify, protect, defend and hold harmless BCA and the City of Burlington, Vermont, and its officials, employees, and agents from and against all liabilities, obligations, claims, losses, damages, judgments, or costs or expenses (including reasonable attorney’s fees) arising from, in connection with, or caused by any infringement of patent, copyright, trademark, trade secret or other proprietary right or any infringement of artist’s rights under 16 U.S.C. § 16a, 16 U.S.C. § 113, or similar state, federal or international law, except for that caused solely by the negligent acts or omissions of BCA.

Artist waiver: Artist agrees that they are participating in a program offered by the City of Burlington. Neither the artist nor any officer, employee, or agent thereof is an employee of the City, and the City is not responsible for payment of taxes on the artist’s behalf, for covering the artist under the City’s policy of worker’s compensation, or for provision of any employment benefit of any kind or nature. Artist knowingly and voluntarily RELEASES AND FOREVER DISCHARGES from any and all claims, rights, causes of action, demands, fees, costs, expenses, and liabilities of any kind against the City whatsoever ARISING FROM OR PERTAINING TO ARTIST’S PARTICIPATION IN THE ABOVE-DESCRIBED PROGRAM WHETHER KNOWN OR UNKNOWN AT THE TIME OF SIGNING, including attorneys' fees.
